Sam Deputy, 917 Carr St., speaking on behalf of Len Freeman, President of Downtown Palatka Inc. said Downtown Palatka has requested placement on the November 9th Commission Agenda regarding possibilities for the future of the Main Street Program.  He gave a memorandum to the Clerk, and said he has given her an agenda request.

Lynda Crabill, 609 S. 14th St., speaking on behalf of the Weed & Seed Neighborhood Revitalization Committee, distributed flyers on National Make a Difference Day, scheduled for Oct. 28.  This is part of the ongoing effort to revitalize Palatka’s Northside. She hopes everyone will join in and be a part of this. She noted Commissioner Norwood and Commissioner Sanders are on the steering committee of Weed & Seed. They are to meet at Emmanuel United Methodist Church at 8:00 for assignments. The USA Weekend Magazine and Points Of Light Foundation sponsor National Make a Difference Day.

PUBLIC HEARING

7351 & 7353 Crill Ave. - Planning Board recommendation to Annex, Amend the Land Use Map and Land Use Element from County Urban Service to City Commercial, and Rezone from County AG (Agricultural) to City C-2 (Intensive Commercial) - PB Case No. 06-029 - Barrington and Joan G. H. Findlater, owners.  Mayor Flagg opened the Public Hearing and asked for Public Comments.

 Public Comment

Mr. Robert A. Wise, 150 Kelley Smith School Road, stated he has concerns with the annexation because the property is now being used as a U-Haul rental company, but the County has no record of it being used as a commercial business. The property in question is zoned County Agricultural.  He went to the County and questioned this, and they have no record of anyone requesting permission to use it as a commercial business. Mr. Wise stated he has nothing against anyone who owns the property but he does not want the City at his back door. Upon investigation, Putnam County Zoning Enforcement served the owner a warning and gave them two weeks to cease operations. He talked with the County Zoning Board and Tax Collector on this, and as of today there is no record of an occupational license being issued for this business. He strongly opposes the annexation of this property into the City. He was never notified that this annexation was going to take place and he lives right next to the property, nor was his neighbor. He recommends taking this back to square one and starting all over again.

Mayor Flagg asked Mr. Wise how he was notified of this meeting. Mr. Wise stated he read it in the newspaper. Mayor Flagg asked Mr. Wise what he was objecting to: the annexation, land use element or rezoning. He noted the land use element now shows County Urban Service, which means although it is outside the City limits, the future use of this property at some point will be in the Urban Service area based on the location of the property. He asked if the objection was that it was no longer going to be in the County, or that the zoning would change from Agricultural to City commercial. Mr. Wise stated he objects to it coming into the City because when that happens it will go to commercial. Mayor Flagg stated the applicant does not have to come into the City to get his property rezoned. Mr. Wise stated he would oppose commercial rezoning if it was left in the County. Mayor Flagg said anytime there is property contiguous to the City, it is eligible to be annexed into the City. Mr. Wise said he cannot understand how annexing this little spot will be advantageous to the City when the County surrounds it. He probably would not be standing here if he had been notified properly, which is one of his objections.

Don Holmes, City Attorney, stated the City has notice requirements, which include mailings, publications and signage. Mr. Holmes stated he is not aware as to whether or not the notice requirements were fulfilled in this case.  That is an issue for the Planning Dept. and Planning Director to specifically address. Mr. Holmes said the mailing is not required to be certified, so there is no USPS green card to show publication or notice from the mailing perspective. Mr. Holmes asked the Planning Director if he had a file that might reflect what notice issues and measures were implemented.

Geoff Pappas, Planning Director, said after an investigation, he discovered that the mailings may or may not have been sent out, but that can’t be verified.  He recommended the matter be sent back to the Planning Board so the proper notices can be sent out to the surrounding landowners. He was verbally informed that the notices had been posted and sent out, but he cannot verify it.  Mayor Flagg noted the former Planning Director stated notification was given, and he had posted signage.  Mayor Flagg asked the petitioner if signage was put on the property.

Mr. Barrington Findlater, owner of the property, stated the signage he saw was yellow and facing Crill Ave. situated between both properties, 7351 & 7353 Crill. Mr. Wise stated if the signs were posted they would still be there, and he has not seen them. Mayor Flagg stated, according to the City Clerk, the previous Planner said he posted the signs himself in June between the driveway and power pole.  Mr. Bush stated he had talked with Adam Mengel at length about this; Mr. Mengel had indicated to him that he had posted the signage in the northeast corner of the property and went into detail of how it was posted and angled facing Crill so people could see it, but he did not mention a specific date.  Mr. Pappas stated this would have been prior to the Planning Board meeting.  Mr. Holmes asked Mr. Wise if, had he known about the Planning Commission hearing, what he would have said and presented to them that he hadn't just presented to the City Commission. Mr. Wise stated he would have still objected to the property being annexed into the City. He has nothing against the City, but if he wanted to live in the City he would have bought a home within the City.  Mayor Flagg asked if Mr. Wise's primary objection was the annexation?  Mr. Wise stated yes; his main objection at this point is running a commercial business in a residential area that is zoned agricultural.  Mayor Flagg noted, at this time, it is under the County’s jurisdiction.  This Commission should, at this time, uphold, amend or deny the Planning Board’s recommendation.  Mr. Wise has had due process.

Mr. Holmes said State Statue simply requires that before the ordinance passes, the City has to meet certain publication requirements.  Had he known this would be an issue tonight, he could have researched the specific statute and cited it.  From his understanding, advertising requirements for this meeting were met.  The Statue also has notice requirements for the Planning Board’s meeting.  The City’s own policies and procedures have a notice requirement or notice standard that is observed prior to the Planning Board hearing. Signs disappear and do not stay in place forever. The fact that the signs are not there now does not mean they weren't there. In the absence of anything in the City Ordinance that requires a certain level of evidence proving that the three notice steps were taken, he does not believe that the City Ordinance says you have to have an affidavit in the file from the Zoning Director affirming he posted the signs. It simply states you go ahead and affect the notice. Mr. Holmes feels the City met and substantially complied with the notice requirements. He asked Mr. Wise if he could advise the Board how he was prejudiced by not receiving notice of the Planning Commission meeting. That is the reason he asked what Mr. Wise would have done differently at Planning Board meeting, than what he has done here at the City Commission meeting. Mr. Holmes stated it is his opinion that the Commission can go forward and consider the matters tonight. Mr. Wise stated he cannot say he was harmed, but if a person buys a piece of property and does not use it properly before a change is even considered, he cannot condone that.  Mayor Flagg stated the present occupational status is not under the City's jurisdiction, and the City declines to give an opinion or any comment on that. Upon request of Mayor Flagg, Geoff Pappas, Planning Director, read page 2 of the August 15 Planning Board Staff Report, Conditions of Approval, into the record (filed).

Commissioner Kitchens said if the County determines this to be an illegal use, it will go before the County Code Enforcement Board and could very well have a County lien placed against it as a code enforcement problem. When this comes into the City it will not wipe out the code enforcement problem associated with the County.  This is something that was not brought to light before the Planning Board, according to the Planning Board minutes. This is something the Planning Board should have known about, and the City should consider it.  She has concerns with bringing a piece of property into the City that may have an existing code enforcement problem. Commissioner Brown asked what this would have to do with the City annexing this into the City. Commissioner Kitchens said if the County puts a code enforcement lien on it, it could go to court and end up some sort of problem.  She does not know if the City is interested in taking in a code enforcement problem, albeit a County code enforcement problem.

Mayor Flagg stated it would be difficult for the Commission to deny this based upon a County Codes issue when there is no official documentation from the County. He does not feel the City has a problem.  Mr. Findlater will have to deal with the County. The Commission has a Planning Board recommendation based upon the regulations concerning annexation, land use amendment and rezoning. If a code issue exists, he does not look at it as the City inheriting anything.  It is a matter of a property owner having to comply with whoever currently regulates the property, which at this time is Putnam County.  If the City annexes it, the City’s Code Enforcement Board is not bound by County Code Enforcement if, in fact, there are violations.

Mr. Holmes

Mr. Holmes stated there was a fire this week at a business that contains papers and artifacts that date back more than 100 years. He was there shortly after the fire out of concern for the business, and the owner was very impressed with the Fire Department’s handling of the call. They were able to get tarps in place to cover the records, papers and documents on the first floor so when they put the fire out on the second floor they didn't destroy them, some of which were irreplaceable. The owners and people on the scene were impressed with the Fire Department. Mayor Flagg asked Mr. Bush to send a commendation letter to be posted at the Fire Department so they will know the Commission is appreciative of their efforts.

Commissioner Norwood

Commissioner Norwood said he has concerns with the issue raised tonight regarding documentation of notification of land use and zoning changes. Mayor Flagg said there should be a checklist for each case, and that is something the staff is working on. Mr. Bush stated it would be an affidavit. Mr. Holmes suggested taking a photo of the signage, shown in place, for the file. Mayor Flagg stated he has full confidence that the Department’s leadership will make sure that the technical details are attained.

Commissioner Norwood said he wanted to thank the City staff for the tremendous job they have done this year, in light of recent retirements and resignation and the delay in filling some of those positions, in keeping the City’s business current. Commissioner Brown stated she would like that in writing for all the Commissioners to sign.

Commissioner Kitchens

Commissioner Kitchens said she received a call from a taxpayer who lives at the corner of President and S. 18th Streets about the problems that come about as a result of the violence following football games, the worst of them being the Palatka – St. Augustine game, which is a long-running rivalry.  This resident said in years past he had spoken with Officer Reno Fells who assured him the PD would have an officer stationed at that intersection until the crowds dispersed from the ball game. She noted twice this year there has been almost a riotous type of situation with 50+ people at that intersection, cars pulling up and people getting out of the cars and actually fighting in the street. She wanted the Commission to be aware that there is a problem there. Mayor Flagg stated he spoke with the resident this evening and he seems to be content and satisfied at this time. It boils down to the number of officers that are being paid to participate in these functions. He suggested Police Chief Gary Getchell follow up on this.

Chief Getchell stated police security is contracted by the School Board. At the City’s expense, they do add additional officers as needed. They know that certain games will generate more issues than others. He has not heard anything regarding these particular issues. Commissioner Kitchens asked if the police car that is parked at different locations could be parked there. Mayor Flagg stated the Chief would get with his detail that helps with order on the streets, and do what is necessary to make it happen.

Commissioner Kitchens also wanted to remind the Commission of the “Merry Christmas” Banners, and asked that whoever it is that makes those purchases to begin that process, as Christmas is coming.  As to the cost, she is willing to donate as much as she can towards that.  Mr. Bush stated Mr. Norton takes care of this, and he will follow up on it.

Commissioner Brown

Commissioner Brown stated she has been looking at housing and housing rehabilitation. She has spoken with the County’s staff that handles the SHIP Program, and found there are 80 people on a waiting list.  It will be two years before SHIP can help anyone else or take another application. They can get help from the Weatherization Program at the Regional Planning Council.  Applications will be put in each Commissioner’s box, along with a Direct Repair Loans/Grant application form. Weed and Seed will be working on this also.

Lynda Crabill, Weed & Seed committee, stated they had their first homeowner/homebuyers seminar at Weed and Seed this past Tuesday night and it was received very well. They are helping people through the processes and working with them any way they can to try and get a home.  Commissioner Brown said Barbara Bradley will be coming to Palatka on November 14th at 6:00 p.m. and would like to do a joint meeting. She would like to have this advertised in the newspaper and possibly have fliers made up. Mayor Flagg asked that John Nelson also be made aware of this.

Commissioner Sanders

Commissioner Sanders stated, as to items stored in the back room of the Annex that belong to a local civic club, they should be removed by Monday.  Much of what is stored back there is junk.  Mayor Flagg noted they addressed some specific things when they toured that building.  The Building Dept., via the City Manager, is to be given a reasonable time-line to get that facility straightened up.  He understands that more than one Department has things stored there.  Commissioner Sanders stated there is a lot of room over there that can be utilized once it is cleaned up. Mr. Pappas said much of that can be taken care of by General Services.

Sam Deputy, 917 Carr St., stated the original 1890 printing equipment that printed the Palatka Gazette is stored there.  Mr. and Mrs. Webb, who owned Palatka Printing, have donated everything to the Historical Society for the City. They probably have the only complete set of that type left in this country. There are newspapers in the Putnam Historical Museum that were printed from that press.  He would like more time to find another spot to store it. The equipment is operational.  They are working with Matthews Moving & Storage to find a place.  Commissioner Sanders suggested buying a storage building and placing it by the Historical Museum. Mr. Bush asked if they have contacted the Palatka Daily News regarding displaying it. Mr. Deputy stated the equipment takes up a large amount of space.  It is the complete print shop, and that is what makes it so rare.

PUBLIC COMMENTS, Revisited

Robert Griffith, 510 Mulholland Park, stated he wanted to give a praise report on Ruth Burk's daughter in California. She had a tumor removed tonight weighing 25 pounds. Mayor Flagg thanked Mr. Griffith for the report and said they will continue to pray for the family.

Betty Starr, 301 Belmont Drive, asked if the public could get protection at the Train Station at night.  The train is never on time.  Mayor Flagg stated the Commission received a status report from the Assistant City Clerk via Jeff Norton from Ride Solution, updating the Commission as to why they do not have the proper staffing levels and things of that nature at the Train Station. It is the City's understanding that there are some things related to funding that has delayed the process. He asked the City Manager to meet with Jeff Norton and the Police Chief so that they can give the Commission some idea of what staffing there is, and what additional staffing is needed.  Commissioner Sanders asked if the station could include a train schedule that is updated.  Mayor Flagg noted he has had complaints of a lack of signage around the facility.  He asked Mr. Bush to put together a team to assess the overall situation.  Commissioner Brown said Amtrak bears some responsibility. Mr. Bush said Amtrak was going to install a Kiosk with a telephone enabling the public to check the status of the trains.  They need to find out what happened to that kiosk.  Commissioner Sanders said if an elderly person is there waiting for the train in bad weather, they have no place to go to get out of it.  Mayor Flagg said they need to look at services across the board.

Mayor Flagg noted the 2007 Palatka City Commission Calendar was distributed for Commission review.

Mayor Flagg commented on the Memorial Bridge street lights and feels they are short-lived. The City Clerk said it is the stem that has gone bad and is something FDOT is addressing.  Mayor Flagg would like an analysis and assessment to what is happening. Mr. Bush stated Jeff Norton has advised Summerville Electric is handling the repairs; the parts are on order.  He will check into this. Mayor Flagg said this is an embarrassment and does not look good. It does not need a bandage; it needs to be fixed.  Commissioner Norwood stated he would like monthly inspections of the bridge.
