NOTICE is hereby given the Palatka City Commission will hold a public hearing to consider the enactment of Ordinance 2023-45 on January 11, 2024 at City Hall 201 N. 2nd St., Palatka, FL 32177
AN ORDINANCE OF THE CITY OF PALATKA, AUTHORIZING THE EXECUTION OF DOCUMENTS ACCOMPLISHING THE RELEASE OF THAT "REVERTER" FOUND IN CITY OF PALATKA ORDINANCE 10-19, THEREBY ELIMINATING THE REQUIREMENT THAT THE PORTION OF NORTH 16TH STREET WHICH LIES BETWEEN ST. JOHNS AVENUE AND REID STREET (HIGHWAY 17) BE USED AS A NEW CAR DEALERSHIP IN ORDER TO AVOID THE REVERSION TO THE CITY OF PALATKA OF THE STREET WHICH WAS VACATED BY ORDINANCE 10-19 AND THE DOCUMENTS AUTHORIZED THEREIN; PROVIDING THAT THE EASEMENT RETAINED BY THE CITY AS DESCRIBED WITHIN ORDINANCE 10-19 WOULD CONTINUE TO BE RETAINED BY THE CITY AND WOULD NOT BE RELINQUISHED OR RELEASED; PROVIDING FOR SCRIVENER'S ERRORS; AND PROVIDING FOR AN EFFECTIVE DATE.

All interested persons are hereby advised of such consideration by the City Commission and all interested parties may appear at said meeting at said time and place and be heard with respect to the proposed ordinance. A business impact statement can be found below. This notice is given in accordance with F.S. 166.041.

Proposed ordinance’s title/reference:
ORDINANCE 2023-45 amending Ordinance 10-19 by striking Section Two and ceding the former right-of-way of 16th Street between Reid Street and St. Johns Avenue as defined in Ordinance 10-19, Schedule A to Palatka CBG, LLC. Owner: Palatka CBG, LLC Parcel No.: 42-10-27-6850-2950-0010 (PB 23-32)

In accordance with the provisions of controlling law, even notwithstanding the fact that an exemption noted above may apply, the City hereby publishes the following information:
1. Summary of the proposed ordinance (must include a statement of the public purpose, such as serving the public health, safety, morals and welfare):
Ordinance 10-19 vacates the City of Palatka N 16th Street right of way between St. Johns Avenue and Reid Street. Section Two of Ordinance 10-19 includes language that allows for the former right of way of N 16th Street between St. Johns Avenue and Reid Street to be reverted to the City of Palatka in the event the subject property is not used as a new car sales center for at least 180 consecutive days. This language includes a list of activities routinely associated with a new car sales enterprise in an ancillary capacity.
It is understood that the property has been used in the capacity of a Beck Chevrolet/Buick new car sales facility in a continuous fashion since the adoption of the ordinance in 2010. There is a small traffic circle within the former right of way of N 16th Street on the parcel. Traffic utilizing that section of N 16th Street is minimal. The owner of St. Johns Auto Body and Towing, a business neighbor to the south of the automobile dealership has provided a letter of support to remove the reverter clause.
Removing the reverter requirement in Ordinance 10-19 would have no effect on City resources as the City currently has no responsibility for maintenance of that section of roadway. The property owner may wish to ensure there are no utilities within the former right of way. The public purpose is to allow the property owner to renovate, rebuild and contribute to local economic development.
The Planning Board met on November 14, 2023 to consider this request and recommended approval.
2. An estimate of the direct economic impact of the proposed ordinance on private, for-profit businesses in the City, if any:
(a) An estimate of direct compliance costs that businesses may reasonably incur;
(b) Any new charge or fee imposed by the proposed ordinance or for which businesses will be financially responsible; and
(c) An estimate of the City’s regulatory costs, including estimated revenues from any new charges or fees to cover such costs.
There are no direct compliance costs a business may incur as a result of this ordinance.

3. Good faith estimate of the number of businesses likely to be impacted by the proposed ordinance:
The only business that may be impacted as a result of this change will be the current business located at 1601 Reid Street.
